CEASEFIRE’s LIMITED WARRANTY

 

For Ceasefire Industries U.K. Limited (hereinafter CEASEFIRE) Branded Products Only.

 

CONSUMER LAW

 

The Limited Warranty is a voluntary manufacturer's warranty available for the Warranty Period (as set out below) of your Product. It provides rights separate to rights provided by consumer law, including but not limited to those relating to non-conforming goods.

 

As such, the CEASEFIRE warranty benefits are in addition to, and not instead of, rights provided by consumer law.

 

If a product is defective consumers may, in addition to any other rights which they may have under consumer law in the UK, avail themselves of the rights contained in the Sale of Goods Act 1979 (in particular Section 12), the Supply of Goods and Services Act 1982 (in particular Section 2) and the Sale and Supply of Goods to Consumers Regulations 2002.

 

Consumers have the right to choose whether to claim service under the CEASEFIRE Limited Warranty or under their consumer law rights.

 

Important: The CEASEFIRE Limited Warranty terms and conditions shall not apply to consumer law claims.

 

WHAT IS COVERED BY THIS WARRANTY?

CEASEFIRE warrants, for the relevant Warranty Period (as set out below), the CEASEFIRE - branded product (Product) against defects in materials and workmanship when installed by CEASEFIRE authorised resellers and providers and used in accordance with CEASEFIRE user manuals, technical specifications (and) and other CEASEFIRE Product published guidelines. You will be able to receive the remedies available under the Limited Warranty for your CEASEFIRE product via your CEASEFIRE reseller or provider (from which it was purchased). In the event of any defect in materials and workmanship, you will be able to direct your claims to CEASEFIRE even in situations where you purchased the CEASEFIRE Product from a third party.

Please note: All claims made under the CEASEFIRE Limited Warranty will be governed by the terms set out in this warranty document.

WHAT IS NOT COVERED BY THIS WARRANTY?

​

This warranty does not apply to any non-CEASEFIRE branded hardware products even if packaged or sold with CEASEFIRE hardware. Non-CEASEFIRE branded products may have the benefit of a manufacturer's warranty, which provides benefits in addition to consumer law rights.

 

This warranty does not apply: (a) to damage caused by use with non-CEASEFIRE products; (b) to damage caused by accident, abuse, misuse, flood, fire, earthquake or other external causes; (c) to damage caused by operating the product outside the permitted or intended uses described by CEASEFIRE; (d) to damage caused by service (including upgrades and expansions) performed by anyone who is not an authorised CEASEFIRE representative or provider; (e) to a product or part that has been modified to significantly alter functionality or capability without the written permission of CEASEFIRE; (f) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship.

 

CEASEFIRE is not responsible for damage arising from failure to follow instructions relating to the product's use or resulting from any tampering, misuse or alteration of the products.

 

CEASEFIRE’s OPTIONS

If you submit a valid claim under this warranty, CEASEFIRE will, at its option:

​

1. repair the Product using new or previously used parts that are equivalent to new in performance and reliability, or

2. replace the Product with a product that is at least functionally equivalent to the Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or

3. refund your purchase price in exchange for the return of your Product.

​

When a product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes CEASEFIRE’S property.

​

A replacement part or product or a repaired CEASEFIRE Product assumes the remaining warranty of the original CEASEFIRE Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.

 

LIMITATION OF LIABILITY

1. Entire agreement:

 

Other than the consumer law rights to which you are entitled as set out at the beginning of this document, all warranties, conditions and other terms not set out in this warranty document are excluded from the Limited Warranty. As a result, CEASEFIRE does not make any other promises, conditions or warranties about the service other than set out in this warranty document.

 

1. Limitation of liability:

 

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW, CEASEFIRE SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. IF CEASEFIRE CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THIS EXPRESS WARRANTY AND TO REPAIR OR REPLACEMENT SERVICE AS DETERMINED BY THE CEASEFIRE IN ITS SOLE DISCRETION. NO CEASEFIRE PROVIDER, RESELLER, AGENT, OR EMPLOYEE IS AUTHORISED TO MAKE ANY MODIFICATION, EXTENSION OR ADDITION TO THIS WARRANTY.

 

THIS WARRANTY SHALL NOT APPLY IF THE RELEVANT PRODUCT IS DAMAGED WHILE IN YOUR POSSESSION, WHETHER DUE TO ACCIDENT, ACT OF GOD, OR OTHERWISE, OR SUBJECTED TO UNREASONABLE USE WHICH CAUSES IT TO MALFUNCTION OR BECOME DEFECTIVE. THE TERM *UNREASONABLE USE* SHALL INCLUDE FAILURE TO PROVIDE REASONABLE AND NECESSARY MAINTENANCE IN ACCORDANCE WITH THE INSTRUCTIONS ON THE LABEL OR ELSEWHERE. CEASEFIRE ASSUMES NO LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES.

 

THIS WARRANTY IS VOID WHERE THERE IS INDICATION THAT THE RELEVANT PRODUCT HAS BEEN DAMAGED, TAMPERED WITH OR APPLIED IN A MANNER THAT IS INCONSISTENT WITH ITS INTENDED USE AS OUTLINED BY CEASEFIRE WARRANTY ALSO VOID IN CASE OF THE INSTALLATION OR THE EQUIPMENT BEING OPENED OR MODIFIED BY ANY ONE NOT AUTHORISED BY CEASEFIRE TO DO SO.

 

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE EXTENT PERMITTED BY LAW, CEASEFIRE IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY. THE FOREGOING LIMITATION SHALL NOT APPLY TO (i) DEATH OR PERSONAL INJURY CLAIMS (ii) FRAUD; (iii) FRAUDULENT MISREPRESENTATION; OR (iv) ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED AS A MATTER OF LAW.

CEASEFIRE will maintain and use customer information in accordance with the CEASEFIRE Privacy Policy available [insert link].

GENERAL

​

No CEASEFIRE reseller, agent, or employee is authorized to make any modification, extension, or addition to this warranty.

​

If any term is held to be illegal or unenforceable, it shall be severed from this warranty and the legality or enforceability of the remaining terms shall not be affected.

​

This warranty is governed by and construed under the laws of England and Wales and each party hereby submits to the non-exclusive jurisdiction of the English courts.
